1- PURPOSE

This website is a platform (hereinafter Seshai Care) owned by POMONA FRAGANCES, S.L., whose purpose is to offer an online shopping service for certain cosmetic items.

III. GENERAL CONTRACTING CONDITIONS

III. a PRICE

The prices of the products are indicated in euros and include V.A.T. applicable on the day of the order. The price invoiced to the purchaser is that indicated in the order confirmation. The prices indicated do not take into account the shipping costs which will be invoiced separately and will be indicated to the purchaser at the time of the final validation of his order.

III.b INFORMATION PRIOR TO THE PROCESS OF PURCHASE OF PRODUCTS BY THE CUSTOMER

The user has full knowledge of the different products offered for sale and can freely browse the different sections without any commitment to place an order.

If the user wants to place an order, he will choose the products he is interested in by clicking on “buy”, or by clicking on the product and once inside the product information page by clicking on “add to cart”.

Each new addition to the cart will be indicated at the top right of the page. At any time, the user will be able to obtain the list of products he/she has selected or modify them by clicking on the “view my cart” box at the top right of the page. The user can also continue shopping by clicking on “continue shopping”.

If the user has completed the selection of products, he/she can place the order by clicking on “confirm” at the top of the page. The shopping cart summary with the selected products will be displayed again. If the list corresponds to the products, he/she has chosen, the user must identify him/herself by indicating his/her e-mail address and password if he/she is a registered user of the store, or fill in exactly the form made available to him/her in which he/she will indicate all the data necessary for his/her identification. Specifically:

The user is informed, (who accepts it), that the data they are giving is used to respond to their searches, process their orders or authorize specific access to the information.

By clicking on “save”, all the data referring to the new user will be saved.

Once the personal data is registered, the user will choose the shipping method and select a shipping address from those previously registered (if there is more than one). In the shipping mode, the amount of the shipping costs with VAT included appears.

The user must mark “I have read the general conditions of sale and I accept them without reservation” to validate before being able to choose the payment method on the same page.

Payments will be made by credit or debit card.

If the user chooses to pay by credit card, they will have to provide their bank details and the order will not be validated until the bank details are on the protected page of the payment entity designated by Seshai Care. In the event that payment with the card is denied, the order will be automatically canceled, informing the customer of said cancellation.

When selecting a payment method, an order summary will appear showing the total amount of the order and the payment option chosen by the user.

The user, already a buyer, validates his order and his payment by clicking on “I confirm my order”. The buyer automatically receives an order confirmation email, with all the details of the order placed.

The buyer can review his order and download the invoice in: “History and details of my orders” within his account.

The purchase process will be formalized in Spanish.

III.c INFORMATION AFTER THE PRODUCT PURCHASE PROCESS BY THE CLIENT

Once the order has been prepared and shipped, the buyer will be sent a shipping confirmation email. The buyer will be able to know the status of their order in their online store account, as well as manage other operations related to their orders.

III.d DISPUTE OR DENIAL OF PAYMENT

In case of rejection of payment by bank card, Seshai Care reserves the right to: suspend the management of the purchase of the product, deny or cancel any purchase of a client with whom there would be a dispute regarding the payment of a previous purchase.

III.e BILLING

At the time of purchasing the product, a detailed purchase invoice will be sent to the postal and email address indicated during the registration process. This document will be accessible at all times in the menu “HISTORY AND DETAILS OF MY ORDERS” of the client’s profile.

The products ordered will be delivered to the address that the buyer has indicated at the time of placing his order. Delivery may be made either to the buyer’s address or to the address of a Seshai Care Certified facility, at the buyer’s choice.

The delivery of the order will be made in an average period of 2 to 6 working days from the day of receipt of the order.

III.g NON-CONFORM ITY

Return policy

• If you want to return an order because you have not been satisfied.

If for any reason your order has not met your expectations, you can return the items you want within 15 business days of receiving your order. The returned items will necessarily go inside their original packaging and in perfect condition. Once verified, we will refund the amount of your initial order.

• If you wish to return an order due to an error on the part of Seshai Care.

If the reason for your return is an error made by Seshai Care (product that does not correspond to your order, defective packaging…), you can return the items within a period of 15 working days from the receipt of your order. Returned items will necessarily go inside their original packaging. Once verified, we will refund the amount of your initial order as well as the return shipping costs.

• If you want to return an order due to an allergy caused by the product or due to poor texture or fragrance.

In this case, we ask you to contact our Customer Service by calling 682 926 039. We will tell you how to process the return.

If the reason for return is dissatisfaction with the product, in no case will returns of products that have been opened or used be accepted.

The refund of the amount of the return will be made in the days next to the receipt of the product and after checking its status.

1. USE OF THE WEBSITE

seshaicare.com provides access to a multitude of information and services (hereinafter, “the contents”) belonging to Seshai Care. The user assumes responsibility for the use of the website. Said responsibility extends to the records that are necessary to access certain services or contents. In these records, the user will be responsible for providing truthful and lawful information. The user undertakes to make appropriate use of the content and services that Seshai Care offers through its website and, including but not limited to, not to use them to (I) engage in illicit, illegal or contrary to good faith activities and to public order; (II) disseminate content or propaganda of a racist, xenophobic, pornographic-illegal nature, advocating terrorism or an attack on human rights; (III) cause damage to the physical and logical systems of Seshai Care, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage; (IV) try to access and, where appropriate, use the email accounts of other users and modify or manipulate their messages. Seshai Care reserves the right to withdraw all those comments and contributions that violate respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that threaten youth or childhood, order or public safety or that, in his opinion, were not suitable for publication because they were not related to the objective. In any case, Seshai Care, as administrator of its website, will act diligently as soon as it becomes aware of acts committed against professional ethics, the image and prestige of Seshai Care, as well as these Conditions of Use or its Privacy Policy.

Seshai Care reserves the right to deny at its discretion, at any time and without prior notice, the access of any user to this website or part of it.

The linked websites are not under the control of Seshai Care and Seshai Care is not responsible for the contents of any linked site or any link contained in any linked website, or any changes or updates to such websites. Seshai Care is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Seshai Care of the web site.

3. INTELLECTUAL PROPERTY RIGHTS

Seshai Care by itself or as an assignee, is the owner of all the intellectual and industrial property rights of its website, as well as the elements contained therein (by way of example: images, audio, video, texts; brands or logos, color combinations, structure and design, etc.), owned by Seshai Care or its licensors. All rights reserved. By virtue of the provisions of articles 8 and 32.1, second paragraph, of Royal Legislative Decree 1/1996, of April 12, which approves the consolidated text of the Intellectual Property Law, regularizing, clarifying and harmonizing the provisions laws in force on the matter, reproduction, distribution and public communication are expressly prohibited, including the method of making them available position, of all or part of the contents of this website, for commercial purposes, in any support and by any technical means, without the authorization of Seshai Care. The user agrees to respect the Intellectual and Industrial Property rights owned by Seshai Care. VII. LIMITATION OF LIABILITY

Seshai Care will be liable for damages that the user may suffer as a result of the use of the website when said damages are directly attributable to an incorrect action by this entity, having proven that it has not complied with the legal and regulatory requirements and requirements. It is the user’s responsibility to adopt all appropriate technical measures to reasonably control the risks of open Internet browsing and prevent damage to their equipment, loss of data and theft of confidential information. VIII. JURISDICTION AND APPLICABLE LAW

The law applicable to this contract will be Spanish Law. For disputes that may arise from this contract, the parties, waiving their own jurisdiction, expressly submit to the Courts and Tribunals of the registered office of Seshai Care.

Seshai Care will pursue the breach of these conditions as well as any improper use of its website, exercising all legal actions that may correspond to it by law.

2. MODIFICATION OF THE CONDITIONS OF USE

Eventually, these Terms of Use may be revised in order to update changes in current legislation, update our information collection and use procedures, the appearance of new services or the exclusion of others. These changes will be effective as of their publication on the web, so it is important that you regularly review these Conditions of Use in order to remain informed about the changes that have occurred.
